By accessing or using NetSpectraAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

NetSpectraAI provides AI-powered network configuration analysis, compliance checking, and infrastructure optimization tools. The Service includes but is not limited to:

• Configuration vulnerability detection
• Compliance framework assessment
• Network topology mapping and analysis
• Predictive analytics and forecasting
• Automated documentation generation

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current account information

4. Subscription Tiers and Billing

NetSpectraAI offers multiple subscription tiers (Free, Starter, Pro, Growth, Business, Enterprise). By subscribing to a paid tier:

• You authorize automatic recurring charges
• Fees are non-refundable except as required by law
• We may change pricing with 30 days' notice
• You can cancel your subscription at any time
• Access continues until the end of the billing period after cancellation

5. Acceptable Use

Users agree to refrain from:

• Using the Service for unlawful purposes or in violation of applicable regulations
• Attempting to gain unauthorized access to systems or networks
• Reverse engineering, decompiling, or disassembling the Service software
• Uploading malicious code or engaging in activities that may harm the Service
• Using the Service in any manner that violates applicable laws or regulations
• Reselling or redistributing the Service without prior written authorization

6. Intellectual Property

All Service content, features, and functionality are owned by NetSpectraAI and protected by intellectual property laws. You retain ownership of your uploaded configuration data.

7. Data Ownership and License

You grant us a limited license to process your network configuration data solely to provide the Service. We do not claim ownership of your data and will not use it for purposes outside of service delivery without your explicit consent.

8. Service Availability

We strive for high availability but do not guarantee:

• Uninterrupted or error-free service
• That the Service will meet all your requirements
• That defects will be corrected immediately

We target 99.9% uptime but are not liable for service interruptions due to maintenance, third-party failures, or force majeure events.

9. Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. NetSpectraAI disclaims all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, NetSpectraAI shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

NetSpectraAI's total aggregate liability for any claims related to the Service shall not exceed the fees paid by you during the twelve (12) months immediately preceding the claim.

11. User Indemnification

You agree to indemnify, defend, and hold harmless NetSpectraAI and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Account Termination

NetSpectraAI may suspend or terminate your account under the following circumstances:

• Material breach of these Terms
• Suspected fraudulent activity
• Non-payment of subscription fees when due
• Use of the Service in a manner inconsistent with these Terms

Upon termination, your access to the Service will cease, subject to applicable data retention policies.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. This provision does not preclude either party from seeking injunctive or equitable relief in court for matters related to intellectual property or confidential information.

14. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law provisions.

15. Modifications to Terms

NetSpectraAI reserves the right to modify these Terms at any time. Material changes will be communicated to users via email or in-app notification at least thirty (30) days prior to the effective date. Your continued use of the Service following notification of changes constitutes acceptance of the modified Terms.
